At Fair Path Legal, we understand that going to family court is one of the most stressful parts of separation. The process can feel overwhelming and challenging. It requires preparation. Knowing what to expect can ease some of the anxiety and help you feel more prepared.
In this blog, we will walk through what usually happens at your first family court hearing, so you know what to expect during this Court event.
In Australia, family law matters such as parenting arrangements, separation, divorce, and property settlements are generally heard in the Federal Circuit and Family Court of Australia. This court operates under strict rules and procedures designed to ensure cases are managed reasonably and efficiently.
Your First Court event is called a Directions Hearing, referring to a case management hearing before a Judicial Registrar, not a Judge or a Senior Judicial Registrar, directing the parties on the next steps for the matter to progress further.
The Judicial Registrar identifies the issues in the application and response to the initiating application and will make Orders for gathering evidence, expert reports, valuations, financial disclosure, orders for service, to complete a parenting course or to attend mediation.
The powers of a Judicial Registrar are limited; you should not expect final orders from the first event unless the parties have reached an agreement.

It’s important to know that family law matters would not be resolved in the first court hearing. The first court date marks the beginning of the process, and this can schedule you a time frame to resolve your matter or to attend mediation before the matter progresses further.
